1. What information do we collect?

      Personal information you disclose to us

      We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

      Personal information provided by you. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

      • Names

      • Email addresses

      • Phone numbers

      • Job titles

      • Company name

      • Company website

      • Contact preferences

      • HubSpot usage information

      • Billing and payment information (processed through our payment providers, not stored directly by us)

      Sensitive information. We do not process sensitive personal information.

      All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

      Information automatically collected

      We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services and for our internal analytics and reporting purposes.

      Like many businesses, we also collect information through cookies and similar technologies. The information we collect includes:

      • Log and usage data. Service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. This log data may include your IP address, device information, browser type, and settings, along with information about your activity in the Services.

      • Device data. Information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

      • Location data. We collect location data such as information about your device's location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Services.

      Information collected when you are a client

      When you engage Fission as a client for our HubSpot operations services, we may access and process additional information within your HubSpot portal and connected systems. This includes CRM records, contact lists, workflow configurations, reporting data, and other information necessary to deliver the Services described in your service agreement. Our access to and use of this data is governed by the terms of your service agreement and, where applicable, a Data Processing Agreement (DPA).

      2. How do we process your information?

      We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

      We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

      • To deliver and facilitate delivery of services. We process your information to provide you with the requested services, including HubSpot operations, consulting, and implementation work.

      • To send you marketing and promotional communications. We may process your information to send you marketing content, including our newsletter (The CRM Code), promotional offers, and information about our services. You can opt out of our marketing emails at any time by clicking the unsubscribe link in any email we send.

      • To send administrative information. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.

      • To fulfill and manage your orders. We may process your information to fulfill and manage your orders, payments, returns, and exchanges made through the Services.

      • To respond to your inquiries. We process your information when you contact us with questions, requests for information, or to book a strategy call.

      • To analyze and improve our Services. We may process your information to understand how our Services are used, identify areas for improvement, and develop new features or offerings.

      • To comply with legal obligations. We may process your information where we believe it is necessary for compliance with our legal obligations.

      • To protect vital interests. We may process your information when necessary to protect your vital interests or the vital interests of a third party.

      3. What legal bases do we rely on to process your personal information?

      If you are located in the EU or UK, this section applies to you.

      The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases:

      • Performance of a contract. We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you.

      • Legitimate interests. We may process your information when we reasonably believe it is necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms.

      • Legal obligations. We may process your information where we believe it is necessary for compliance with our legal obligations.

      • Vital interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party.

      If you are located in Canada, this section applies to you.

      We may process your information if you have given us specific permission (i.e., express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time.

      4. When and with whom do we share your personal information?

      We may need to share your personal information in the following situations:

      • Service providers and subprocessors. We may share your information with third-party service providers who perform services on our behalf. Our key service providers include:

        • HubSpot, Inc. for CRM, marketing automation, email delivery, website hosting, and analytics

        • Google LLC for website analytics (Google Analytics 4) and search performance monitoring (Google Search Console)

        • Stripe, Inc. (or other payment processors) for payment processing

      • AI tool providers. We use AI-powered tools to enhance our service delivery. See Section 5 for details on how data is handled in this context.

      • Business transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

      • Legal requirements. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process.

      We do not sell your personal information to third parties. We do not share your personal information with third parties for their own direct marketing purposes.

      5. How do we use AI tools in our services?

      Fission uses artificial intelligence tools to enhance the quality and efficiency of the services we provide to clients. We believe in being transparent about this usage.

      How we use AI

      We may use AI-powered tools and services, including large language models, to assist with tasks such as:

      • Analyzing CRM data patterns and providing recommendations

      • Drafting operational documentation and process guides

      • Generating reports and data summaries

      • Optimizing workflows and automation configurations

      • Conducting diagnostic assessments of HubSpot portals

      Data handling with AI tools

      When we use AI tools in connection with client services:

      • We process the minimum amount of data necessary for the task at hand

      • Client data submitted to AI tools is not used to train the AI provider's models (we use commercial/API tiers that contractually prohibit training on customer data)

      • AI-generated outputs are reviewed by our team before being delivered to clients

      • We select AI providers that maintain appropriate security and privacy practices

      Some features on our website, such as our diagnostic assessment tool, use AI to process information you voluntarily submit.

      6. Do we use cookies and other tracking technologies?

      We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information. We use these technologies for the following purposes:

      • Essential cookies. Required for the website to function properly, including session management and security features.

      • Analytics cookies. Help us understand how visitors interact with our website by collecting and reporting information (via HubSpot analytics and Google Analytics 4).

      • Functional cookies. Enable enhanced functionality and personalization, such as remembering your preferences.

      • Marketing cookies. Used to track visitors across websites to display relevant advertisements and measure ad campaign effectiveness. These are placed by HubSpot's tracking code.

      Managing your cookie preferences

      When you first visit our website, you will be presented with a cookie consent banner that allows you to accept or decline non-essential cookies. You can update your cookie preferences at any time through the cookie settings link in our website footer.

      7. How long do we keep your information? 

      We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

      When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

      8. How do we keep your information safe?

      We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. These measures include:

      • Using encrypted connections (HTTPS/TLS) for all data transmission

      • Limiting access to personal information to authorized personnel who need it to perform their job functions

      • Using reputable, enterprise-grade service providers (HubSpot, Google) with their own security certifications

      • Regularly reviewing and updating our security practices

      • Maintaining commercial general liability insurance (including electronic data liability coverage) and a separate cyber liability insurance policy

      However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure. We cannot promise or guarantee that unauthorized third parties will not be able to defeat our security and improperly collect, access, or modify your information.

      9. Do we collect information from minors?

      We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.

      10. What are your privacy rights?

      In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right to request access and obtain a copy of your personal information, to request rectification or erasure, to restrict the processing of your personal information, and, if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information.

      Withdrawing your consent

      Opting out of marketing and promotional communications

      You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send.

      11. Controls for do-not-track features 

      Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals.

      We do honor Global Privacy Control (GPC) signals where required by applicable law. If our systems detect a GPC signal from your browser, we will treat it as a valid opt-out request for the sale or sharing of personal information, where applicable.

      12. United States state-specific privacy rights

      California residents (CCPA/CPRA)

      If you are a California resident, you are granted specific rights regarding access to your personal information under the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA/CPRA").

      Virginia, Colorado, Connecticut, Texas, Oregon residents

      If you are a resident of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Texas (TDPSA), or Oregon (OCPA), your state's consumer privacy law provides you with certain rights regarding your personal data, including the right to access, correct, and delete your personal data, the right to opt out of targeted advertising, the sale of personal data, and profiling, and the right to data portability.

We will respond within the timeframe required by applicable law (typically 45 days, with a possible 45-day extension if reasonably necessary).

      13. International data transfers

      Our Services are hosted in the United States via HubSpot's infrastructure. If you access the Services from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the United States, then through your continued use of the Services, you are transferring your data to the United States, and you expressly consent to have your data transferred to and processed in the United States.

      If you are located in the European Economic Area (EEA), UK, or Switzerland, please note that the United States may not have data protection laws that are equivalent to those in your country. We rely on appropriate safeguards, including contractual protections with our service providers, to ensure that your data is protected in accordance with this privacy notice and applicable law.

      14. Do we make updates to this notice?

      We may update this privacy notice from time to time. The updated version will be indicated by an updated "Last Updated" date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification.
